Eighty Four Mining Co. v. Morris
Morris worked as a coal miner for nearly 35 years, 19 years underground. Morris’s breathing difficulties caused him to leave work. In 2006, Dr. Cohen diagnosed him with pneumoconiosis (black lung disease). Eighty Four Mining’s physician also examined Morris, but determined that Morris’s breathing difficulties were caused by smoking and that there was no radiographic evidence of pneumoconiosis. In 2008, aPennsylvania Workers’ Compensation Judge denied benefits. Morris did not appeal. Morris’s breathing problems worsened; a doctor put him on oxygen nearly full-time. In 2011, Morris sought Black Lung Benefits Act (BLBA), 30 U.S.C. 901, benefits. He did not rely upon the 2006 report that had been discredited, but on a 2011 arterial blood gas study and pulmonary function testing that supported a finding of black lung disease. In 2013, an ALJ granted BLBA benefits, rejecting a timeliness challenge and reasoning that a denial of black lung benefits due to the repudiation of the claimant’s pneumoconiosis diagnosis renders that diagnosis a “misdiagnosis” and resets the three-year limitations period for subsequent claims. Morris sufficiently established the existence of pneumoconiosis through medical evidence obtained after 2010 and Eighty Four failed to adequately explain why Morris’s years of coal dust exposure were not a substantial cause of his impairment. The Benefits Review Board affirmed, citing judicial estoppel as precluding the timeliness argument. The Third Circuit denied a petition for review. View "Eighty Four Mining Co. v. Wiest v. Tyco Elec. Corp
Wiest, formerly a Tyco employee, claimed that Tyco unlawfully terminated his employment for reporting suspected securities fraud violations pertaining to the accounting treatment of two Tyco events, in violation of the anti-retaliation provision of the Sarbanes-Oxley Act, 18 U.S.C. 1514A. Wiest claims that for six months, he refused, as an accountant, to process payments allegedly due from Tyco that related to two Tyco employee and dealer meetings in resort settings. Tyco contends that Wiest’s involvement with the events at issue was minimal and he did not frustrate, or even inconvenience, Tyco’s management, and that ,more than eight months later, Tyco’s human resources director—who had no knowledge of, Wiest’s alleged protected activity— investigated complaints that Wiest made inappropriate sexual comments to several female Tyco employees, and that he had inappropriate sexual relationships with two subordinates, resulting in Wiest’s termination. The Third Circuit affirmed summary judgment for Tyco. Wiest failed to offer any evidence to establish that his protected activity was a contributing factor to any adverse employment action; Tyco established that it would have taken the same actions with respect to Wiest in the absence of Wiest’s accounting activity given the thoroughly documented, investigation conducted by its human resources director. Moore & Co., P A v. Majestic Blue Fisheries LLC
Under the South Pacific Tuna Treaty (SPTT), a limited number of licenses to fish the waters of the Pacific Island nations are available to vessels under the control and command of U.S. citizens. Moore, a law firm, filed suit under the False Claims Act against Korean nationals and LLCs, alleging that the LLCs acquired two SPTT licenses by fraudulently certifying to the U.S. government that they were controlled by U.S. citizens and that their fishing vessels were commanded by U.S. captains. Moore first learned of this alleged fraud through discovery in a wrongful death action that it litigated in federal court against two of the defendants. The district court dismissed, citing the FCA’s public disclosure bar and its “original source” exception, particularly the 2010 amendments to those provisions. The Third Circuit reversed, finding that the alleged fraud was disclosed through any of the qualifying public disclosure sources, but that Moore has materially added to those public disclosures by contributing details of the alleged fraud that it independently uncovered through discovery in the wrongful death action in federal court. In re: Dr. Lakshmi Arunachalam
Arunachalam is a plaintiff in several related patent infringement actions in the U.S. District Court for the District of Delaware. Arunachalam unsuccessfully moved to disqualify the district judge on the basis of the judge’s ownership of mutual funds that have holdings in certain of the defendant corporations. Arunachalam challenged that ruling by seeking a writ of mandamus to order the judge’s disqualification. The Third Circuit concluded that it lacked jurisdiction and directed the Clerk to transfer the case to the United States Court of Appeals for the Federal Circuit. The court stated that it may issue writs of mandamus only “in aid of” its jurisdiction, and it will not possess appellate jurisdiction over the final orders in the patent infringement actions. Whitehead v. Pullman Group LLC
Singer-songwriters John Whitehead and Gene McFadden were “an integral part of the 1970s Philadelphia music scene. In 2002, Pullman approached them about purchasing their song catalogue. The parties signed a contract but never finalized the sale. Pullman claims he discovered tax liens while conducting due diligence and that the matter was never resolved. Whitehead and McFadden passed away in 2004 and 2006, respectively. Pullman became embroiled in disputes with their estates over ownership of the song catalogue. The parties eventually agreed to arbitration. Pullman, unhappy with the ruling, unsuccessfully moved to vacate the arbitration award on the ground that the panel had committed legal errors that made it impossible for him to present a winning case by applying the Dead Man’s Statute, which disqualifies parties interested in litigation from testifying about personal transactions or communications with deceased or mentally ill persons.” The Third Circuit affirmed, stating that the arbitrators did not misapply the law, but that legal error alone is not a sufficient basis to vacate the results of an arbitration in any case. In re: Wettach
Wettach was a partner at theTitus law firm, which rented space from Trizec under a long-term lease. After the firm's 1999 dissolution, Trizec filed suit against Titus’s former partners for unpaid rent. The Pennsylvania court found the partners jointly and severally liable for more than $2,700,000. Before that court entered final judgment Wettach filed a voluntary Chapter 7 bankruptcy petition, listing $3,551,500 in assets, including $2,951,500 in personal property, retirement accounts, insurance, and a checking account held by the entireties with his wife. Wettach claimed all of this property as exempt, primarily relying on the exemption for property held by the entireties, 11 U.S.C. 522(b)(1), (3)(B). Wettach joined another law firm and earned wages that the firm directly deposited into the entireties account. The Trustee claimed that these deposits constituted recoverable fraudulent transfers. Before the bankruptcy court could rule, the case was reassigned. The parties consented to the court issuing findings without a new trial. The court ruled in favor of the Trustee, awarding $428,868.12, plus $37,139.01 in interest. The district court and Third Circuit affirmed, rejecting challenges to allocation of the burdens of persuasion and production on the fraudulent transfer claims; evidentiary findings; and a legal determination that the deposit of wages into an account held by the entireties constituted “transfer” of an “asset” under Pennsylvania state law. In re: Trump Entm’t Resorts
The Debtors own the Atlantic City Trump Taj Mahal casino. The union represents 1,136 employees. The 2011 collective bargaining agreement was to remain in effect through September 14, 2014 and continue in full force and effect from year to year thereafter, unless either party served 60 days written notice of its intention to terminate, modify, or amend. In March 2014, the Debtors gave notice of their “intention to terminate, modify or amend” and sought to begin negotiations. The Union initially declined. On August 20 the parties met. The Debtors emphasized their critical financial situation. No agreement was reached. The Debtors filed for Chapter 11 bankruptcy. On September 11, the Debtors asked the Union to extend the term of the CBA. The Union refused. The CBA expired. On September 17, the Debtors sent the Union a proposal with supporting documentation. After meetings, the Debtors successfully moved, under section 1113, to reject the CBA and implement the terms of the Debtors’ last proposal, asserting that rejection of the CBA was necessary to the reorganization.While 11 U.S.C. 1103 allows a debtor to terminate a CBA under certain circumstances, the National Labor Relations Act prohibits an employer from unilaterally changing CBA terms even after its expiration; key terms of an expired CBA continue to govern until the parties reach a new agreement or bargain to impasse. The Third Circuit affirmed, finding section 1113 does not distinguish between the terms of an unexpired CBA and terms that continue to govern after the CBA expires. Finkelman v. Nat’l Football League
The Ticket Law, N.J. Stat. 56:8-35.1, part of New Jersey’s Consumer Fraud Act, says: It shall be an unlawful practice for a person, who has access to tickets to an event prior to the tickets’ release for sale to the general public, to withhold those tickets from sale to the general public in an amount exceeding 5% of all available seating for the event. The Consumer Fraud Act permits private plaintiffs to sue any person who violates the Act and causes them to suffer ascertainable damages. Plaintiffs wanted to attend Super Bowl XLVIII, which was held in New Jersey in 2014. One plaintiff bought two tickets on the resale market, allegedly for much more than face price. They assert that the NFL’s method of selling tickets to Super Bowl XLVIII violated the Ticket Law and resulted in unjust enrichment. The Third Circuit affirmed dismissal. Neither plaintiff has constitutional standing to bring this case. Otherwise, anyone who purchased a Super Bowl ticket on the resale market would have standing to sue in federal court based on nothing more than conjectural assertions of causation and injury. Article III requires more. The court declined to interpret the Ticket Law’s

Connelly v. Lane Constr. Corp
In 2006, Lane hired Connelly as one of seven union truck drivers at its Pittsburgh facility. Connelly ranked fifth in seniority and was the only woman. In 2007, allegedly because Connelly had ended a romance with a co-worker (Nogy), her male co-workers began “curs[ing] ... and belittl[ing] her." Connelly notified supervisors. Lane suspended Nogy for three days but did not discipline or warn any other employees, who continued to harass Connelly. In 2009, Connelly learned about the company’s “Ethics Line,” which she called multiple times to report further harassment and make complaints about her male co-workers drinking on the job. In 2010, a Lane foreman made an unwanted physical advance to Connelly, which she reported to the Ethics Line and to her supervisor. In October 2010, a Lane supervisor became “incensed” at Connelly when she refused to drive a truck that had a flat tire and steering problems. Soon after, Connelly was laid off before the end of the construction season and before any other union truck driver. She was never recalled her to work. Lane did recall male truck drivers in 2011 and continues to employ them. The Third Circuit vacated dismissal of Connelly’s suit, which alleged disparate treatment, sexual harassment, hostile work environment, and retaliation under 42 U.S.C. 2000e, finding her claims plausible. Group Against Smog & Pollution, Inc. v. Shenango Inc
The environmental group, GASP, sued Shenango, which operates the Neville Island Coke Plant, a coke manufacturing and by-products recovery facility in Allegheny County, Pennsylvania. The district court dismissed the citizen suit, finding that that the administrative agencies were already “diligently prosecuting” the alleged Clean Air Act violations, so that GASP’s action was prohibited by the diligent prosecution bar of the Act. 42 U.S.C. 7604(b)(1)(B). The Third Circuit affirmed, stating that the diligent prosecution bar of the Act is not a jurisdictional limitation, but that GASP’s action was properly dismissed through a Rule 12(b)(6) motion for failure to state a claim.
